Motorcycle Road Rash Injury Attorney in Austin

You Deserve Compensation for Someone Else’s Mistake

Road rash occurs when an individual’s skin is scraped off after contact with a road surface. It is extremely common following motorcycle accidents and very painful, as sliding against pavement at high speeds can leave a raw wound with unprotected tissue exposed. In severe instances, the injury can cause nerve damage, leaving little or no sensation in the damaged area.

Motorcyclists are at high risk of suffering road rash because they are less protected than occupants of larger, more sheltered motor vehicles. While helmets and protective clothing can help, serious accidents can still lead to painful road rash despite the protection.

If you or a loved one suffered a motorcycle crash in Austin, please contact the King Law Firm at (512) 375-4455 to obtain more information regarding your legal rights and options.

What Is Road Rash?

Road rash is one of the most common types of non-fatal motorcycle accident injuries. Also known as road burn, road rash occurs when the rider is dragged across the ground. The ground grates the exposed skin of the rider, causing agonizing abrasions on the body.

Although most road rash injuries are not deadly on their own, the severe damage can lead to terrible infections, long-lasting tissue damage, and severe scarring.

The three types of road rash are as follows:

  • First Degree: This classification of road rash is identified by small scrapes, redness, bruising, minor bleeding, and tenderness of the wounded area. It is crucial the wound be cleaned and treated in order to avoid infections. First-degree road burn is considered a minor injury and can typically be treated at home.
  • Second Degree: Second-degree road rash is marked by steady bleeding, swelling, radiating heat, and exposed muscle, tendons, and/or nerves. It is important for victims to keep the wound clean and seek medical attention immediately. Scarring is common with second-degree road rash and can even cause reduced mobility of the wounded area.
  • Third Degree: In third-degree road rashes, skin is completely scrapped off, causing severe bleeding, intense swelling, and deep lacerations. It may be a degloving injury. In certain instances, the area may have a shiny or milky appearance. These injuries can be excruciatingly painful, or not painful at all due to severe nerve damage. Contusions may expose muscle, bone, nerves, and tendons. Seek medical attention at once and try not to meddle with the wounds, as infection can set in fast. Scarring and permanent deformity are commonplace for individuals who are victims of third-degree road rash.

No matter what, you should always get your motorcycle-related injuries looked at by a medical professional. Not only can medical professionals diagnose the severity of the rash, they can also properly clean and treat the rash, so infection does not set in.

Collecting Damages for Road Rash

If your motorcycle accident was caused by the negligence of another person, you may be able to pursue compensation from that party in a court of law. You can get money for repairs or replacement of your motorcycle, medical treatment, and compensation for pain and suffering associated with the accident.

Texas has a modified comparative negligence system when it comes to determining fault after an accident. In a personal injury lawsuit, the court will review the details and look over any police reports or eyewitness accounts to determine who was at fault. They will then assign a percentage of fault to each party involved in the accident, and any damages will then be reduced by the percentage of fault. For example, if the jury awarded $100,000 for the plaintiff's injuries but decided that the plaintiff was 20% responsible for the accident in question, the plaintiff's recovery would be reduced to $80,000.
