Texas Motorcycle Accident Lawyer
The wide-open expanses of the Texas landscape make it a great state for motorcycle riding. But some factors make Texas a difficult state to recover damages from a motorcycle accident.
Changes in Motorcycle Helmet Laws
Motorcycle helmet laws in Texas have undergone a lot of changes and may be confusing. Legislation in 1997 made helmets mandatory only for those under 21, but required an exemption sticker for those 21 and older who wanted to ride helmet-free. The exemption sticker program was repealed in 2009, essentially removing all restrictions from Texas motorcyclists 21 and older wanting to enjoy the open road.
Unfortunately, more riders without helmets has resulted in more serious injuries from motorcycle accidents. Judges and juries aren’t very sympathetic to a motorcyclist injured when not wearing a helmet.
Uninsured Drivers
The 2009 repeal of the exemption sticker program meant motorcyclists no longer had to carry minimum liability insurance. In fact, many Texans let their minimum liability insurance policies lapse after they’ve registered their vehicles. Approximately 20% of Texas drivers are uninsured or underinsured. If you have the misfortune of getting into an accident with one of these drivers, you may have little recompense without your own Underinsured Motorist Insurance policy.
If you’ve been injured in a motorcycle accident, you need a lawyer to help you get the compensation you’re entitled to. Insurance companies—even yours—don’t want to pay out, so you need someone with experience to fight for you against unreasonable motorcycle accident claim denials, delays or small settlements that don’t help you recover from out-of-pocket medical bills and lost wages.
